The Official State Gazette No. 97, of April 21, 2018, approved Royal Decree-Law 3/2018 of April 20, which amends Law 16/1987 of July 30, on the Regulation of Land Transport regarding the leasing of vehicles with drivers (VTC).
Due to the significant increase in vehicle leasing with drivers, and specifically the disputes that have arisen with the taxi drivers' union in urban areas, this amendment has been necessary.
The 1987 LOTT (Spanish Law on the Rent of Vehicles with Drivers) incorporates new conditions for leasing vehicles with drivers, as well as the authorizations that enable them to do so, in order to alleviate the conflicts that have arisen.
The aim is to establish a law that will allow for the consistent application of the regulations issued at the regional and municipal levels regarding public passenger transport in passenger vehicles, with the regime for vehicle leasing activities with drivers.
For a VTC permit to be granted, it will be issued for every thirty taxi licenses existing in the territory of each Autonomous Community. These Autonomous Communities may modify the proportionality rules to include less restrictive ones.
It would be regulated in section 3 of article 48 of the LOTT, which, in turn, reproduces article 181.3 of Royal Decree 1211/1990, which is hereby repealed. Article 91.2 of the LOTT requires that the leasing authorizations of vehicles with drivers must be national in scope, and that these vehicles must allocate 80% (quarterly) to providing transport services in the territory of the Autonomous Community in which they are domiciled. The provision of article 182.5 of the ROTT of 1990 is elevated to the rank of Law. Article 9.1 of the LOTT is also amended.
Improvements in the competitiveness and coordination of this activity are emerging, based on the different modes of passenger transport in passenger vehicles. Therefore, in accordance with Article 9.1 of the LOTT (Spanish Transport Law), it was agreed to hold an extraordinary meeting of the National Transport Conference to analyze and identify aspects and measures at the state and regional levels that could be modified to improve the competitiveness, competence, service provision, and coordination of the urban and interurban areas of this activity in its different modes of passenger transport in passenger vehicles. The legislative amendment came into force on April 22, 2018.
